Not Sure If You’re Entitled To Claim For Compensation?
Tragedy can strike can strike unexpectedly. Every day, dozens of Americans suffer from unjust injuries The thing to remember is this: You are not alone and you don’t have to take this lying down. Local, State, and Federal law offers an immense amount of protection in personal injury cases. And though no amount of money can make it completely right, at least financial compensation can help you improve your life and the life of your loved ones. As with every endeavor, this one should begin with research. Empower yourself with knowledge so that you are prepared for the meeting with your lawyer. We have taken it upon ourselves to compose a list of generally-accepted injury categories and some of their legal implications.
Assault and/or Battery: Assault/Battery claims can be brought in two types of courts: A criminal court and a civil court. You don’t have to worry about criminal charges because these will be handled by your district attorney. But don’t expect them to have your best interests in mind. A DA will pursue the maximum sentence for the perpetrator (assuming no complicating circumstances) but will not spend any time seeking compensation for the victim. That has to be done in a civil trial. Also, if for some reason the defendant won the criminal case, they may still lose the civil one. The standard of evidence is much less strict in civil court, where the plaintiff only need prove a “preponderance of evidence,” as opposed to providing evidence “beyond a reasonable doubt.”
Defective Product Injury: A free market economy depends on the transparent flow of information. Consumers have to know that when they buy a car, their brakes won’t burn into sludge when they slam them. If they didn’t have that confidence, there would be no domestic auto-market. Still, as the last few years have proven, companies don’t always have our best interests in mind. Frequent product recalls from reputable brands such as Johnson & Johnson, Bayer, ReNu, Jiffy, and Honda have become the norm. Obviously, you won’t be able to win a lawsuit like this on your own. But if you have suffered from a defective product you bought in the US, you should do some research: Chances are you are not the only one. Connect with other victims and find a lawyer to bring a class-action lawsuit.
Animal Injury: America loves animals, and most of us are responsible pet-owners. Sadly, millions of people are bitten by dogs each year, though very few go on to press charges. The law is clear here: It is not the dog’s fault if it bit you– It’s the owner’s. They have made the decision to take care of an animal and must provide the proper training and protection for those around them. Most animal injury victims are children who were targeted by aggressive animals due to their size and inattentiveness. Don’t ignore the physical and psychological impact of an animal attack. If you or your child were bitten, seek medical and legal counsel as soon as you can.
Industrial Injury: Workplace protection has gone a long way in the States. Most industrial sites are now OSHA-certified and have quality assurance and safety supervisors. However, a few hundred incidents of industrial injury surface each year. They are an inevitable consequence of a modern economy. These cases tend to be pretty straightforward as the victim has only minimal necessity for proof and the accidents tend to have multiple witnesses.
Medical Negligence Injury: One of the reasons that health insurance is such a topic in the US is because of medical negligence injury. These have become so common in the last few years that doctors are forced to take out Rolls Royce insurance policies– And they pass the cost off to the consumer. Ironically, these policies have not made us any safer. On the contrary, doctors know the insurance provider will pay the victims so they have become even more likely to slip up. A scary thought. Medical negligence is very serious: It can range from misdiagnosing a patient, and thus delaying their proper care, to prescribing a harmful medication.
